Installation of a new video-conferencing system at the Prince Albert Provincial Court ensures residents of northern Saskatchewan have better access to court services.

  1. Appointments as Commissioners for Oaths must be registered with the Ministry of Justice and Attorney General. Telephone Court Services Branch at (306) 787-4117 if you require assistance with your application.
     
  2. There are two types of appointments:
    • Appointment: within Saskatchewan
      A Commissioner for Oaths in and for Saskatchewan administers oaths, takes and receives affidavits, declarations and affirmations within Saskatchewan only. A person receiving this type of appointment must be a Canadian citizen or other British subject and 18 years of age or more.
       
    • Appointment: without Saskatchewan
      A Commissioner for Oaths without Saskatchewan administers oaths, takes and receives affidavits, declarations and affirmations outside Saskatchewan for use in Saskatchewan, in or concerning any cause, matter, or thing pending in a court of Saskatchewan or in any way concerning any of the proceedings in such court or otherwise. A person receiving this type of appointment does not have to be a Canadian citizen or British subject, but must be 18 years of age or more.
       
  3. The fee for either type of appointment is $100.00 ($200.00 for both), with these exceptions:

    • Highway Traffic Board as traffic officer or other employee
    Chair of the Highway Traffic Board$10.00

    Applications received without the required authorization will be returned to the applicant.
     
  4. Please submit the following to this office:
    • The application, completed in full, signed and dated on pages 1 and 2 as required.
       
    • A cheque for any required fees, payable to the MINISTER OF FINANCE.

  5. The Commissioner for Oaths Application form now requires the applicant to disclose any criminal record and includes consent for the Ministry of Justice and Attorney General to inquire into whether or not the applicant has a criminal record.

General Remarks

Every applicant for an appointment as a Commissioner for Oaths should become familiar with The Commissioner for Oaths Act and Regulations.

Expiry date of appointment

Appointments are for 5-year terms.  The expiry date of all appointments will be noted on the certificate of appointment.  If you wish to continue your appointment, please reapply before the expiry date by filling out the application.

Penalties 

  • Anyone appointed Commissioner for Oaths, who fails to write or stamp on every affidavit, declaration, affirmation or certificate made before him or her, the date on which his or her appointment expires, is liable on summary conviction to a fine not exceeding $50.00 and costs. 
  • Anyone appointed Commissioner for Oaths, who signs a document before it has been fully completed, including the jurat, shall, upon summary conviction be liable to a penalty of not more than $50.00.

Evidence of Appointment 

Every Commissioner for Oaths is issued a certificate as evidence of appointment.  If you change your name, you must obtain a new certificate showing your changed name.  For instructions on what is required to change your name on your certificate, please telephone Court Services Branch at (306) 787-4117.
