The Sales on Consignment Act regulates brokers and agents who sell agricultural or farm products (except milk, cream, grain and livestock) on consignment in Saskatchewan on behalf of a producer.

The Act does not apply to co-operative associations.

The Act requires mercantile agents to:

  • obtain the producer's consent and give clear disclosure of all material circumstances before buying any consigned products;
  • comply with record-keeping requirements;
  • report damaged products in a consignment;
  • account to the producer respecting a sale of a consignment, including a monthly account of any portion of a consignment that is unsold; and
  • keep money from the sale of the products separate and either pay the producer immediately or deposit the money in a trust account.

The Minister of Agriculture may authorize any person to inspect the records and premises of mercantile agents.
