Saskatchewan Justice

The International Commercial Arbitration Act implements the Model Law adopted by the United Nations Commission on International Trade Law. The Model Law is a code of procedure for arbitrating commercial disputes.

The Act provides that if an action between a Saskatchewan corporation and a corporation in another jurisdiction is brought before a Saskatchewan court and the matter is subject to an arbitration agreement, the court shall refer the matter to arbitration if requested by one of the parties. The court must also stay any related proceedings before the court.
