The Improvements Under Mistake of Title Act protects a person who has mistakenly made lasting improvements to land under the belief that the land is his or her own. Either that person or his or her assigns are:

  • entitled to a lien upon the land to the extent of the amount by which the improvements enhance the value of the land; or
  • entitled or may be required to keep the land if the court is of the opinion that this is just under the circumstances.

The person entitled or required to keep the land must pay any compensation to the original owner as the court may direct.
