The Enforcement of Maintenance Orders Act, 1997 establishes a Maintenance Enforcement Office to register and enforce maintenance orders and agreements.

It also provides a number of enforcement measures, including:

  • lump-sum and continuing garnishments, as in the case of a garnishment against the respondent's salary or wages; and
  • the seizure of personal property, bank accounts or real estate.

Two additional remedies, available only to the Director of the Maintenance Enforcement Office, are:

  • a claim against the respondent's pension funds; and
  • suspension of the respondent's driver's licence.
