Dependent Adults

The Public Guardian and Trustee is appointed by the Lieutenant Governor in Council to protect vulnerable persons' property including administering the property and finances of adults who are incapable of managing their own financial affairs.

The Adult Guardianship and Co-decision-making Act

The Adult Guardianship and Co-decision-making Act sets out the procedures for the appointment of:

• a personal or property guardian for individuals who are incapable of managing their own personal or financial affairs;
• a personal or property co-decision-maker for adults requiring assistance in decision-making but who do not require guardians; and
• temporary personal or property guardians in emergency situations.

An application and a capacity assessment must be made in accordance with the Act. The court determines whether it is appropriate to appoint a guardian or co-decision-maker and what duties and powers need to be exercised by them.
