The Enforcement of Maintenance Orders Act, 1997 establishes a Maintenance Enforcement Office to register and enforce maintenance orders and agreements.

It also provides a number of enforcement measures, including:

  • lump-sum and continuing seizures, as in the case of a seizure against the payor's salary or wages; and
  • the seizure of personal property, bank accounts or real estate.

Additional remedies, available only to the Director of the Maintenance Enforcement Office, are:

  • a claim against the payor's pension funds or RRSPs;
  • suspension of the payor's driver's licence; and
  • preventing a payor from securing a hunting or angling license.
