The Act sets out the procedures for the appointment of:

  • a personal or property guardian for individuals who are incapable of managing their own personal or financial affairs;
  • a personal or property co-decision-maker for adults requiring assistance in decision-making but who do not require guardians; and
  • temporary personal or property guardians in emergency situations.

An application and a capacity assessment must be made in accordance with the Act.  The court determines whether it is appropriate to appoint a guardian or co-decision-maker and what duties and powers need to be exercised by them.  The Act establishes requirements on some decision-makers such as the requirement for inventories and accountings.  The Public Guardian and Trustee may also be appointed by the court to act pursuant to this Act.
