The Freedom of Information and Protection of Privacy Act has two main purposes:

  • Access to records - it allows any person to apply for access to records in the possession or under the control of a government institution in Saskatchewan, subject to certain exemptions.
  • Protection of Privacy - it establishes privacy rules for how the government may collect, use and disclose personal information.

Requesting Information

How do I get information from a government agency?

First, contact the appropriate government agency.  They may be able to help you immediately or refer you to someone who can.  If you can't get the information you need through the regular channels, use The Freedom of Information and Protection of Privacy Act

Who can make requests for information?

The Act allows any person to request information.

How do I request information?

Complete an application form by filling in your name, address and a description of the record that provides enough information to identify the records you need.

Where do I submit my access request form?

A completed access request form should be submitted to the government institution that has the records you are requesting.  For a list of access and privacy contacts for all government institutions click here or call the Access and Privacy Branch at (306) 787-5473.

How long does a typical request take?

The government institution has 30 days to respond from the date the institution receives the application.  This may be extended in limited circumstances.  You will be informed if this happens.

What are the fees for requesting information?

Fees may apply when an applicant is given access to a record or part of a record. These may include:

  • Charges for copies of records, including $0.25 per page for a photocopy;
  • If more than two hours are spent searching for a record or preparing it for disclosure, a fee of $15 for each half-hour will be assessed for that additional time;
  • If a search and retrieval of electronic data is required, a fee equal to the actual cost, including machinery and operator costs, will be assessed.

If the fee is thought to be over $50, an estimate must be given to you by the government institution.

No fees are payable where access to a record is refused.

Will I get all the records I request?

In most cases, you will be given access to the records you request.  However, certain records may be exempt from disclosure.  For example, records that contain personal information about another individual are not accessible without consent of that individual or legal authority.

Please refer to Part III of The Freedom of Information and Protection of Privacy Act for a complete list of exemptions.

What if I am refused access?

If you are refused access to a record or part of a record, or if you are not satisfied with other decisions of the government institution related to your request, you may ask the Information and Privacy Commissioner to review the decision.  If the Commissioner reviews the matter and you are still not satisfied, the decision can be appealed to the Court of Queen's Bench.
